Terms of Service

1. The Service

Eightleads is an AI-assisted reactivation and research product that helps teams email people who already signed up for their product, reconcile out paying customers, draft and send outreach (including through connected Gmail accounts), track replies, and generate insight reports. Features may change over time as we improve the Service.

2. Eligibility and accounts

You must be able to form a binding contract and use the Service only for lawful business purposes. You are responsible for the activity under your account and for keeping access credentials secure. If you sign in with Google, you must have the right to connect that Google account and any Gmail mailbox you authorize.

3. Your content and lists

You retain ownership of contact lists, brand materials, campaign settings, drafts, and other content you upload or create in the Service (“Customer Content”). You grant Eightleads a limited license to host, process, and display Customer Content solely to provide and improve the Service for you.

You represent that you have all rights and consents needed to upload contacts and to email them, and that your outreach complies with applicable laws (including anti-spam, marketing, and privacy laws) and with Google’s and other providers’ acceptable use policies.

4. Email and Gmail access

If you connect Gmail, you authorize Eightleads to send and read messages as needed for outreach and reply tracking, within the scopes you grant. You are responsible for reviewing drafts when review-first mode is enabled, for pausing sending when appropriate, and for honoring unsubscribe and suppression requests. We do not guarantee inbox placement, reply rates, or business outcomes.

5. Acceptable use

You agree not to:

• Use the Service for unlawful, deceptive, or harassing outreach
• Upload or email lists you do not have a legitimate right to contact
• Attempt to bypass safety controls, rate limits, or account restrictions
• Reverse engineer, abuse, or disrupt the Service or its infrastructure
• Use the Service to send malware, phishing, or content that violates third-party rights

We may suspend or terminate access if we reasonably believe these Terms or applicable law have been violated.

6. AI-generated output

The Service uses AI to draft emails, classify replies, and produce reports. Output may be incomplete, inaccurate, or inappropriate for your situation. You are responsible for reviewing and approving content before it is sent or relied on for business decisions.

7. Third-party services

The Service may integrate with third parties such as Google (authentication and Gmail), hosting providers, and AI vendors. Your use of those services may also be subject to their terms and policies. We are not responsible for third-party outages, policy changes, or actions outside our control.

8. Fees

If paid plans or usage-based fees apply, pricing and billing terms will be presented at purchase or in your account. Fees are non-refundable except where required by law or expressly stated otherwise.

9. Intellectual property

Eightleads and its licensors own the Service, including software, branding, and documentation. These Terms do not grant you any right to copy, modify, or redistribute our intellectual property except as needed to use the Service as intended.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT EMAIL DELIVERABILITY OR RESULTS WILL MEET YOUR EXPECTATIONS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EIGHTLEADS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED U.S. DOLLARS (US $100) IF YOU HAVE NOT PAID ANY FEES.

12. Indemnity

You will defend and indemnify Eightleads against claims, damages, and expenses arising from your Customer Content, your outreach, your violation of these Terms, or your violation of applicable law or third-party rights.

13. Termination

You may stop using the Service at any time and may disconnect Google / Gmail access. We may suspend or terminate the Service or your account with notice when reasonably practicable, or immediately for misuse, legal risk, or non-payment. Provisions that by nature should survive (including ownership, disclaimers, liability limits, and indemnity) will survive termination.

14. Privacy

How we collect and use personal data is described in our Privacy Policy, which is incorporated into these Terms by reference.

15. Changes

We may update these Terms from time to time. We will post the updated version on this page and revise the “Last updated” date. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
